END USER LICENSE AGREEMENT (EULA)

Course Timetable Software

IMPORTANT - READ CAREFULLY: This End User License Agreement ("Agreement") is a legal agreement between you (either an individual or a single entity, referred to as "User" or "You") and Course Timetable ("Licensor") for the Course Timetable software application ("Software").

By clicking "I Agree" or by installing, copying, or otherwise using the Software, you agree to be bound by the terms of this Agreement. If you do not agree to the terms of this Agreement, do not install or use the Software.

1. LICENSE GRANT

Subject to the terms and conditions of this Agreement, Licensor grants you a non-exclusive, non-transferable license to:

• a) Install and use the Software on computers within ONE (1) single educational institution only
• b) Use the Software for creating and managing course timetables for educational purposes within that single institution
• c) Make backup copies of the Software for archival purposes

2. SINGLE INSTITUTION LICENSE RESTRICTION

THIS LICENSE IS VALID FOR ONE (1) EDUCATIONAL INSTITUTION ONLY.

• a) Each license permits use by only one school, college, or university
• b) Sharing, distributing, or using this Software across multiple institutions is strictly prohibited without purchasing additional licenses
• c) VIOLATION PENALTY: Unauthorized use of this Software by more than one institution, or sharing/distributing the Software to other institutions, will result in a mandatory penalty of TWENTY THOUSAND EUROS (€20,000) per unauthorized institution, plus all legal fees incurred by Licensor
• d) By using this Software, you acknowledge and accept this penalty clause

3. RESTRICTIONS

You may NOT:

• a) Reverse engineer, decompile, or disassemble the Software
• b) Rent, lease, lend, sell, redistribute, or sublicense the Software
• c) Remove or alter any copyright, trademark, or other proprietary notices
• d) Use the Software for any illegal or unauthorized purpose
• e) Share your license with other institutions without written permission and payment of additional license fees
• f) Transfer your license to another institution without prior written consent

4. INTELLECTUAL PROPERTY

The Software is licensed, not sold. Licensor retains all right, title, and interest in and to the Software, including all intellectual property rights.

5. DATA AND PRIVACY

• a) The Software stores data locally on your computer and communicates with Licensor servers for license verification and payment processing
• b) You are responsible for maintaining backups of your data
• c) User registration data (email, name, institution) is stored for license management purposes
• d) You are responsible for complying with data protection laws applicable to student and staff information

6. EDUCATIONAL USE

This Software is intended exclusively for educational institutions (schools, colleges, universities) for the purpose of creating academic timetables. Commercial use outside of educational context requires a separate commercial license. Contact luckydebugger@gmail.com for inquiries.

7. ACCEPTANCE OF RISKS AND BUGS

BY USING THIS SOFTWARE, YOU EXPRESSLY ACKNOWLEDGE AND ACCEPT THAT:

• a) The Software may contain bugs, errors, defects, or other issues
• b) The Software may not function as expected in all circumstances
• c) You assume all risks associated with using the Software
• d) You will not hold Licensor liable for any bugs, errors, crashes, data loss, scheduling conflicts, or any other software issues
• e) You are solely responsible for verifying the accuracy of any timetables or schedules generated by the Software

8. WARRANTY DISCLAIMER

THE SOFTWARE IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND. LICENSOR DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. LICENSOR DOES NOT WARRANT THAT THE SOFTWARE WILL BE ERROR-FREE, BUG-FREE, OR UNINTERRUPTED. YOU USE THE SOFTWARE ENTIRELY AT YOUR OWN RISK.

9. LIMITATION OF LIABILITY

IN NO EVENT SHALL LICENSOR BE LIABLE FOR ANY SPECIAL, INCIDENTAL, INDIRECT, OR CONSEQUENTIAL DAMAGES WHATSOEVER (INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF BUSINESS PROFITS, BUSINESS INTERRUPTION, LOSS OF BUSINESS INFORMATION, SCHEDULING ERRORS, DATA LOSS, OR ANY OTHER PECUNIARY LOSS) ARISING OUT OF THE USE OF OR INABILITY TO USE THE SOFTWARE, EVEN IF LICENSOR HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

10. SUBSCRIPTION AND PAYMENT

• a) The Software requires an annual subscription fee for continued use
• b) Payment is processed through secure third-party payment providers
• c) License validity is verified upon each use of the Software
• d) Failure to renew subscription will result in loss of access to the Software

11. UPDATES AND SUPPORT

• a) Licensor may provide updates, patches, or new versions at its discretion
• b) Updates may be installed automatically or require user action
• c) Technical support is provided via email at luckydebugger@gmail.com
• d) Support response times are not guaranteed

12. TERM AND TERMINATION

• a) This license is effective until terminated or subscription expires
• b) This license will terminate automatically if you fail to comply with any term
• c) Upon termination, you must destroy all copies of the Software
• d) Termination does not release you from the penalty obligations in Section 2

14. GOVERNING LAW

This Agreement shall be governed by and construed in accordance with the laws of the European Union and applicable international copyright laws.

15. ACKNOWLEDGMENT

BY CLICKING "I AGREE" OR INSTALLING THE SOFTWARE, YOU ACKNOWLEDGE THAT:

• a) You have read this Agreement and understand it fully
• b) You agree to be bound by its terms and conditions
• c) You accept all risks associated with using the Software, including bugs and errors
• d) You understand the €20,000 penalty for unauthorized multi-institution use
• e) You are authorized to accept this Agreement on behalf of your institution
